C3 Official Contest Rules
NO PURCHASE NECESSARY TO ENTER OR TO WIN. ALL FEDERAL, STATE, LOCAL AND MUNICPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.
- Eligibility. The C3 December 2007 Contest is open to all legal United States residents, who as of December 5, 2007 are at least 18 years of age and have a valid e-mail account. Employees of New American Dream, Giving Tree Group, EchoDitto, Brighter Planet, Inc., Kimpton Hotels, Chico Bags, NAU, Stay Vocal, Reusablebags.com, and each of their respective affiliated companies or agents and the immediate family members of, and any person domiciled with such employees, are not eligible. New American Dream is not responsible for contest line failures or errors in any promotional graphics or advertisements. Winner must be in compliance with all contest rules.
- Method of Entry. The C3 December 2007 Contest begins on December 5, 2007 at 11 a.m. EST and all entries must be received via online entry at C3.newdream.org by 11:59 pm EST on January 6, 2008. Each entry must include your name, zip code and valid email address along with the Bring Your Own Bag pledge and a recommendation of 50 words or less on a creative idea to inspire other people to take the Bring Your Own Bag pledge. Only one entry per person.
- Selection of winners. The Grand Prize winner will be selected by a panel of judges appointed by New American Dream and announced on or about January 15, 2008. The decision of the judges in all matters related to the selection of the winner and all matters relating to this contest are final. Entries will be judged based upon the creativity, positive tone, originality, and relevance of the recommended idea to inspire additional pledges and the success of such approach to inspire additional pledges, based upon the volume of friends referred.
Odds of winning depend upon the number and quality of eligible entries received. - Prizes. The prize package is as follows:
a. One (1) Grand Prize will be awarded. The Grand Prize will be a Live, Learn, Experience Climate Change package selected and purchased by Brighter Planet, Inc., including:
Live: Reduce your carbon footprint and get in shape by biking to work and running errands on your new commuter bike brought to you by Brighter Planet. Both the estimated carbon footprint of the production of the bike and the estimated carbon output from its shipping will be offset by Brighter Planet.
Learn: Start to build your climate change library. Brighter Planet will send you one copy each of Bill McKibben’s book “Deep Economy,” Jon Isham’s book “Ignition: What You Can Do to Fight Global Warming and Start A Movement,” Michael Pollen’s “Omnivore’s Dilemma,” and Alex Steffen’s “Worldchanging: A Users Guide for the 21st Century.” Brighter Planet will offset the estimated carbon output from both the production and shipping of the books.
Experience: A trip for two to Glacier National Park. On our current course scientists estimate that by 2030 there will no longer be glaciers in Glacier National Park. Brighter Planet wants you to see these glaciers and experience first hand the changes wrought by a warming climate. Meet with leading researchers on the issue of climate change, while hiking, walking, and relaxing in one of America’s greatest natural treasures.
The experience package is for travel Thursday through Sunday, including a three night stay in a hotel in Glacier National Park, entry to the Park and roundtrip transportation for two via train or air from the Winner's choice of seven departure points: Atlanta, GA; Chicago, Il; Denver, CO; Minneapolis/St. Paul, MN; New York, NY, Salt Lake City, UT; and Seattle, WA. Winners choosing train travel will enjoy luxury accommodations aboard the Empire Builder train to Glacier Park from either Seattle or Chicago. Connecting service is available from the seven departure points; however certain departure points will require travel time beyond the Thursday through Sunday experience described above. Winners choosing to arrive by air will fly into Glacier Park International Airport.
Restrictions: Winner and his/her guest must travel together on the same itinerary to Glacier National Park. In addition, the Winner and guest are responsible for obtaining travel insurance (and all other forms of insurance) that they may wish to obtain (at their own expense) and hereby acknowledge that Brighter Planet, Inc. has not obtained and will not obtain or provide travel insurance or any other form of insurance. The trip must be initiated by February 8, 2008 and completed by February 8, 2009. Certain other travel restrictions may apply. No prize substitutions, cash equivalent, or transfer of the Prize is permitted, except by Brighter Planet, Inc. Brighter Planet, Inc. reserves the right, at its discretion, to substitute a prize (or portion thereof) of comparable or greater value in the event of circumstances beyond their reasonable control. Winner's guest must be eighteen (18) years or older (or if the guest is a minor, his or her parent or legal guardian must execute and return a Liability Release prior to the issuance of travel documents or such guest will not be permitted to travel). This offer is made on a space available basis and is not valid for travel December 24-January 1, Memorial Day and Labor Day Weekend and Thanksgiving. The Winner should contact Brighter Planet, Inc. to schedule the trip at least 30 days prior to the desired date of departure.
The total retail value of the Grand Prize is valued at approximately $5,000.
b. One (1) Second Prize will be awarded. The second prize will be three one-night-stay gift certificates to be redeemed at any Kimpton Hotel in the U.S. The total value of the three certificates is $600. Transportation, meals, phone and other incidentals not included.
c. One (1) Third Prize will be awarded. The third prize will be two Nau jackets valued at $330.
d. Twenty-five (25) Fourth Prize winners will each receive a reusable shopping bag from Chico Bags valued at $5.
- Winner Notification and Acceptance. Winners will be notified via email by January 10, 2008. Winners will be solely responsible for reporting and payment of any taxes, fees and damage deposits, as well as all other costs associated with claiming the prize. There shall be no prize substitutions. Winners will be required to complete an affidavit of eligibility and a liability and publicity release (except where prohibited by law) which must be received by New American Dream within (7) days of the postmark. Failure to sign and return the affidavit or release within seven (7) days, or to comply with any term or condition of these Official Rules, may, at the sole discretion of New American Dream, result in a winner’s disqualification, the forfeiture of his or her interest in the prize and the award of the prize to an alternate winner. The Grand Prize winner agrees to participate in a photo/video opportunity with New American Dream.
- Participation: Entries that include content that violates the rights of third parties (including, but not limited to, rights of copyright) will be disqualified. Participants grant New American Dream the right to use their names in advertising and promoting the contest without further compensation. Submitted ideas become the property of New American Dream and New American Dream has the right, but not the obligation to use the ideas for cause related marketing. By participating, contestants agree to be bound by these Official Rules and the decisions of the judges. New American Dream reserves the right to disqualify persons found tampering with or otherwise abusing any aspect of this contest as solely determined by New American Dream. In the event the contest is compromised by tampering or other causes beyond the reasonable control of New American Dream which corrupts or impairs the administration, security, fairness or proper operation of the Contest, New American Dream reserves the right in its sole discretion to suspend, modify or terminate the Contest. Should the Contest be terminated prior to the stated expiration date, New American Dream reserves the right to award prizes based on the entries received prior to the termination date. All decisions regarding disqualification of entries shall be in the judges’ sole discretion. New American Dream is not liable for lost, late, delayed, damaged, incomplete, misdirected entries, email or transactions that are lost or for failure to receive entries due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware or software, whether originating with sender or New American Dream. In the event of a dispute, all email entries will be deemed to have been submitted by the owner of the email account from which they were sent. For these purposes, an email account holder shall mean the natural person assigned to such email account by the Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with such email account.
- Limitations of Liability. By entering the Contest, entrant agrees that all disputes, claims, and causes of action arising out of or in connection with the contest, or any prizes awarded, shall be resolved individually without resort to any form of class action; any claims, judgments and awards shall be limited to actual out-of–pocket costs incurred, including costs associated with entering the contest, but in no event attorney’s fees and under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages other than damages for actual out of pocket expenses.
- Construction. All issues and question concerning the construction, validity, interpretation and enforceability of these official contest rules, or the rights and obligations of any contestant and New American Dream, shall be governed by, and construed in accordance with the laws of the State of Maryland, without giving effect to any choice of laws or conflict of law rules or provisions that would cause the application of the laws of any jurisdiction other than Maryland. In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provisions were not contained therein.
- General Release. By entering the Contest, contestants release New American Dream, Brighter Planet, Inc. and their respective affiliated companies and agents from any liability whatsoever for any claims, costs, injuries, losses or damage of any kind whatsoever arising out of or in connection with the Contest or with the acceptance or possession of any prize (including, without limitation, claims, costs, injuries, losses or damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light). By participating in the Contest, the participant acknowledges that Brighter Planet, Inc. is not responsible for the conduct of the Contest. New American Dream is solely responsible for the conduct of the Contest.
- Sponsor. The C3 December 2007 contest is sponsored by New American Dream, whose decisions regarding the selection of winners and all other aspects of the Contest shall be final and binding in all respects. New American Dream will not be responsible for typographical, printing or other inadvertent errors in these Official Contest Rules or in other materials related to the Contest.
